This report analyses the opportunities and challenges for Kenyan firms from the African Continental Free Trade Area's Investment Protocol. It provides insights from a new survey of 79 private sector respondents on issues related to investment in Kenya.

The Investment Protocol negotiations aim to establish a coordinated approach to investment across Africa, including measures to enhance the investment climate. While the protocol may not significantly liberalise market access, it could strengthen protections for investors. The discussions may also spur complementary national policies in Kenya to improve its investment climate.

Survey respondents provide views on Kenya's current investment protection, facilitation and promotion efforts in light of the AfCFTA agreement. The report argues Kenya should leverage the protocol negotiations to establish a better regime for investor protection while increasing investment promotion and facilitating efforts to attract more foreign direct investment.
